Terms and Conditions of Sale  


All sales generated by RACER AUSTRALIA PTY LTD are subject to the following terms and conditions:

ORDER PROCEDURE


Please fax or email in your order whenever possible to avoid miscommunication.
  1. All orders must be accompanied by customers official written order confirmation.
  2. If you fax through a written copy of a phone in order, it must be clearly marked “confirmation” or it may be taken as a new order.
  3. If for any reason part of phone order was not despatched you will be advised by Fax/Phone and those goods will go on Back order. You can advise us to cancel the order at this time if you desire.
  4. As “Back Order” goods become available, the goods are despatched.
  5. Invoicing method, description of goods supplied and method of freight deemed most suitable by the Company will be used unless specific and complete instructions are received on the customers written order confirmation.

FREIGHT POLICY
 

  1. The freight charges will be added to your invoice for each order dispatched , or if you wish, you may nominate your own carrier.
  2. Loss or damage in transit is not covered unless you request insurance cover. This can be provided at a nominal cost, but it must be requested by you. Goods lost or damaged in transit, if not insured, shall be the liability of the buyer and payment for such goods will be the responsibility of the buyer and payable when due or on demand.
  3. In any case where the company offers transit insurance the decision and/or allowance by the insurance provider will be final and binding on the customer. RACER AUSTRALIA PTY LTD will not be liable for any difference in cost or for any compensation in any form. Basic policy excess shall apply on all claims and payable by customer.
  4. Orders placed with us will ordinarily be processed and dispatched immediately or within 24/48 hours, or as may be the case when goods become available.
  5. All goods are thoroughly checked before leaving our premises. When received, all goods must be checked for shortages, and condition. Any shortage or problem must be advised to our office immediately or within 5 days of receipt of goods. No claims shall be recognised, if no report has been lodged.

ACCOUNTS POLICY AND TRADING TERMS


An account credit application form must be duly completed and signed by every customer and the original sent back to our office. A credit check is done on all customers, approval is given and advised to customer of credit limit on the account in writing.

Prepayment is required against proforma invoice or customer’s order for customers without account.

Goods may be supplied on COD basis where monies must be received within 7 days of invoice date. All indent orders are strictly net 7 days from invoice date. For goods supplied on a COD basis, account application form giving company details and a signature is required to confirm acceptance of the terms and conditions of sale.

Our credit terms are strictly nett 30 days from statement date, that is all previous month invoices to be paid on or before 30th day of the following month. Any account which overrides 45 days will be on stop credit and will be on hold until payment is received.

Repeated late payments may result in suspension of the account and monthly penalty levy of 5% of each invoice value or $10-00, whichever is greater to be charged on each invoice not paid on due date.

An accounting fee may be charged on prolonged payments at the discretion of management. Management reserves the right to terminate credit facilities of any customer at its discretion without any reason.

TITLE OF OWNERSHIP


Property and ownership in the goods shall remain with the Racer Australia until such time Racer Australia has received payment of purchase price of the goods. Until such time as property and ownership passes to the customer, the customer shall hold the goods as bailee of Racer Australia and shall remain liable to account to Racer Australia for the goods. The customer shall store the goods until such time and shall not remove any markings, which identify the goods as a Racer product. If at such time the right to sell the goods passed onto the customer to sell the goods can cease immediately if a receiver, liquidator or administor, or order of banruptcy against the customer goes into voluntary liquidation. The customer must provide access for a member of Racer to enter any premises of the customer for the purpose of removing the goods from the said location.

RETURN GOODS POLICY


Goods will only be accepted back if the goods supplied were not as originally ordered.or that the goods supplied were faulty.

It is essential that the following procedures be followed for return of goods:

You must have your purchase invoice number and date of purchase available to process any returns.

Customer must contact our office first to obtain a return authorisation within 5 days of receipt of goods. The goods must be returned to us within 5 days of the authorisation. Freight Prepaid.

Goods approved for return must be returned in original packaging, original condition and be resellable.

Please state senders name and reason for return with a copy of purchase invoice on any returned goods.

    Please note:
  1. Goods will not be accepted for credit without return Authorisation and will be sent back to you freight collect.
  2. Goods will not be accepted for credit if a request for credit is not lodged within 5 days of receipt of goods.
  3. Replacement goods, if any, will be invoiced to your account and the returned goods credited on receipt.
If goods returned for credit because they were wrongly ordered or no longer required, a minimum re-stocking fee of 10% of the value of goods may be charged for processing returns/credits.

Indent ordered or specially procured items are not returnable under any circumstances.

WARRANTY AND CLAIMS POLICY

All goods sold by us carry a 12 month replacement of parts/goods warranty only on a back to base basis unless specified otherwise. Tyre and Battery items carry 3 months replacement warranty and pro-rata thereafter. Electrical goods are not covered by this warranty.

Warranty on some goods may vary and shall be advised for these products.

To register claim on any goods:
  1. Contact our office first.
  2. Fill out a claim form.
  3. Send goods back to us with full details so goods can be assessed for claim. Freight must be prepaid.
  4. In some cases, goods may have to be sent to manufacturers abroad for assessment on claim. The cost of this shall be paid by us and whatever the outcome of this assessment shall be the final result of the claim. The extent of liability shall only be to the maximum invoice value of the goods only.

If proper procedure is not followed for claims, the claim shall not be processed. Proof of purchase (Invoice Number and date shall be supplied on each claim).

MISCELLANEOUS

Our terms and conditions are governed by and are interpreted in accordance governed by the state of Victoria and all parties agree to submit to the exclusive jurisdiction of the courts of Victoria.

If one or more provision (or part therefore) of these terms is or becomes void, voidable for any reason whatsoever all other provisions (or part thereof) shall remain intact in it's effect.

Acceptance of our goods is an acknowledgement of acceptance towards our terms and conditions. No other conditions can be implied or included without the written acceptance by Racer Australia.
